Colorado Open Meetings Law

Public access to board meetings per C.R.S. § 24-6-402

All meetings of the Southern Park County Fire Protection District Board of Directors at which a quorum is present and at which any public business is discussed or formal action may be taken are open to the public. The District fully complies with the Colorado Open Meetings Law ("Sunshine Law"), C.R.S. § 24-6-402.


The public is encouraged to attend all board meetings. Public comment opportunities are provided at each regular meeting.

C.R.S. § 24-6-402(2)(a) — Open Meetings All meetings of two or more members of any state public body at which any public business is discussed or at which any formal action may be taken are declared to be public meetings open to the public at all times. No resolution, rule, regulation, ordinance, or formal action shall be valid unless taken or made at such open meeting.
C.R.S. § 24-6-402(2)(c) — Meeting Notices Full and timely notice to the public of any meeting at which the adoption of any proposed policy, position, resolution, rule, regulation, or formal action occurs or at which a majority or quorum of the body is in attendance, or is expected to be in attendance, shall be given.
Notice Requirement — Regular Meetings Notice of regular board meetings is posted at the District's principal office and on this website. Agenda items are posted at least 24 hours before the meeting. For special meetings, notice is provided as soon as practicable, but at least 24 hours in advance (C.R.S. § 24-6-402(2)(c)).

Meeting Minutes

Official records of board actions — approved and posted per C.R.S. § 24-6-402 and C.R.S. § 32-1-905

Board meeting minutes are the official record of all actions taken by the Board of Directors. Minutes are approved at the subsequent regular board meeting and posted on this website for public inspection.


Minutes include: roll call and attendance, approval of prior minutes, all motions and votes, executive session notice (if any), and adjournment.

C.R.S. § 32-1-905 — Minutes The board of directors shall keep and maintain a record of its proceedings. The minutes of each meeting shall be available for public inspection at the principal office of the district during regular business hours.

Colorado Open Records Act (CORA)

Public records requests per C.R.S. § 24-72-201 et seq.

All public records of the Southern Park County Fire Protection District are subject to inspection and copying under the Colorado Open Records Act (CORA), C.R.S. § 24-72-201 et seq. Any person may inspect public records during regular business hours or submit a written records request to the Custodian of Records.


C.R.S. § 24-72-203 — Inspection of Public Records All public records shall be open for inspection by any person at reasonable times, except as provided by law. The custodian of public records shall allow any person the right to inspect public records and to make copies thereof, upon payment of a reasonable fee.
C.R.S. § 24-72-203(3)(b) — Response Time The custodian shall respond to a records request within three (3) business days of receiving the request. If the records cannot be produced within that period, the custodian shall notify the requester and may have up to seven (7) additional business days to produce the records, with written notification of the reason for the delay.

How to Submit a CORA Request

  1. Identify the records you are seeking with reasonable specificity
  2. Submit a written request to the Custodian of Records (in person, mail, or email)
  3. Include your name and contact information
  4. The Custodian will respond within 3 business days
  5. Copying fees may apply per C.R.S. § 24-72-205

  • Personnel policies (not personnel records)
  • Service plan and boundary maps
  • Mill levy certifications
  • Election records (subject to applicable limitations)
C.R.S. § 24-72-204 — Allowable Denials Certain records may be withheld from public inspection, including: personnel files, work product, attorney-client privileged communications, medical/mental health records, ongoing investigation records, and other records specifically exempted by law. Any denial must be in writing with the specific statutory basis stated.

Executive Session Records

Compliance with C.R.S. § 24-6-402(2)(d) and § 24-6-402(4)

🔒 When Executive Sessions May Be Held

Executive sessions are permitted only for the following purposes under C.R.S. § 24-6-402(4):

  • Purchase, acquisition, or sale of real/personal property
  • Conferences with the District's attorney for legal advice
  • Matters required by law to be kept confidential
  • Specialized details of security arrangements
  • Personnel matters (not general policy)
  • Developing negotiating positions

📋 Executive Session Procedures

  • Motion, second, and vote required before entering executive session
  • Specific topic announced publicly before convening
  • No final action taken during executive session
  • Written summary of topics retained by District
  • Electronic recording may be made at District's discretion
  • Return to open session before any formal action

📝 Executive Session Log

The District maintains a record of all executive sessions held, including date, statutory basis, and topics discussed (in general terms). This log is available for public inspection upon request.
